These Terms of Service (“Terms”) govern your access to and use of the Island Seeker website, database, subscription services, and related products and services (collectively, the “Service”).
By accessing or using Island Seeker, you agree to these Terms. If you do not agree, you must not use the Service.
1. About Island Seeker
Island Seeker provides access to information and data relating to private islands and other real estate opportunities around the world, including property listings, asking prices, locations, descriptions, images, links, and other market information.
Island Seeker is an information and research service. We are not a real estate broker, agent, investment adviser, financial adviser, lawyer, or representative of any property owner or seller unless expressly stated otherwise.
A property appearing on Island Seeker does not mean that Island Seeker represents the seller or has independently verified the property.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use paid features of the Service.
You are responsible for ensuring that your use of the Service complies with the laws applicable to you.
3. Accounts
Certain features require an account or paid subscription.
You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity conducted through your account.
Accounts and subscriptions are intended for the registered user and may not be shared, resold, transferred, or made available to third parties unless Island Seeker expressly permits this.
We may suspend or terminate accounts where we reasonably believe there has been unauthorized access, account sharing, scraping, abuse, fraud, or another violation of these Terms.
4. Subscriptions and Payments
Some Island Seeker content and features require a paid subscription.
Prices, billing periods, and features included with each subscription are displayed at the time of purchase.
Unless stated otherwise at checkout, subscriptions automatically renew for the same billing period until cancelled.
You authorize us and our payment providers to charge the applicable subscription fees and any applicable taxes using your selected payment method.
We may change subscription prices from time to time. Any price change affecting an existing subscription will apply to a future renewal and will be communicated where required by applicable law.
5. Cancellation
You may cancel your subscription at any time through the available account or billing controls or by contacting us.
Unless otherwise stated, cancellation prevents future renewals. You will continue to have access to the paid Service until the end of your current paid billing period.
Cancellation does not automatically entitle you to a refund for amounts already paid.
6. Refunds
Except where otherwise stated on the Service or required by applicable law, payments are non-refundable once access to the paid Service has been provided.
If Island Seeker advertises a specific money-back guarantee or refund policy when you purchase a subscription, that policy will apply to the relevant purchase.
Nothing in these Terms limits any mandatory refund, withdrawal, or consumer rights that cannot legally be excluded.
7. Property Listings and Data
Island Seeker collects and organizes information from multiple sources, which may include property owners, brokers, agents, public sources, listing platforms, websites, databases, and other third-party sources.
We aim to provide useful and up-to-date information, but we do not guarantee that any listing or information is accurate, complete, current, or error-free.
In particular:
- properties may have already been sold or withdrawn;
- asking prices may have changed;
- property boundaries, sizes, ownership information, development rights, zoning, and other details may be inaccurate or incomplete;
- photographs or descriptions may not reflect the property’s current condition; and
- third-party links may change or become unavailable.
Users should independently verify all material information before making any decision or entering into any transaction.
8. No Guarantee of Availability
A property displayed as being for sale may no longer be available.
Island Seeker does not guarantee that you will be able to contact a seller or broker, receive a response, inspect a property, make an offer, or purchase any property displayed through the Service.
9. No Investment, Legal, Tax, or Financial Advice
Nothing on Island Seeker constitutes investment, financial, legal, tax, valuation, or other professional advice.
Information provided through the Service is intended for general informational and research purposes only.
Purchasing an island or other real estate can involve substantial financial, legal, environmental, political, regulatory, and operational risks. You should conduct your own due diligence and obtain appropriate professional advice before making a transaction.
10. Third-Party Websites and Services
Island Seeker may link to third-party websites, brokers, agents, listing platforms, mapping services, or other external services.
These third parties operate independently from Island Seeker. We do not control and are not responsible for their content, availability, security, accuracy, policies, products, or services.
A link to a third party does not necessarily constitute an endorsement or recommendation.
Your interactions or transactions with third parties are between you and the relevant third party.
11. Intellectual Property
The Island Seeker website, database structure, branding, design, software, compilations, original research, and other proprietary content are owned by or licensed to Island Seeker and are protected by applicable intellectual property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to access and use the Service for your own lawful purposes.
No ownership rights are transferred to you.
12. Restrictions on Use
Unless we provide written permission, you may not:
- scrape, crawl, spider, harvest, or systematically extract data from the Service;
- use automated tools to collect listings or other information;
- reproduce or republish substantial portions of our database;
- create or maintain a competing property or private-island database using Island Seeker data;
- sell, sublicense, redistribute, or commercially exploit access to the Service or its data;
- share paid account credentials with unauthorized users;
- circumvent subscription, access, security, or technical restrictions;
- interfere with the operation or security of the Service; or
- use the Service for unlawful, fraudulent, or abusive purposes.
Reasonable use of individual listings and information for personal property research is permitted.
13. User Communications
If you contact Island Seeker, submit information, suggest a property, or otherwise communicate with us, you represent that you have the right to provide the information you submit.
You remain responsible for your communications and any information you provide.
14. Service Changes
We continuously update the Service. Listings, datasets, features, pricing, functionality, and availability may therefore change over time.
We may add, modify, suspend, or discontinue parts of the Service where reasonably necessary.
We do not guarantee that any particular listing, dataset, feature, or functionality will remain available permanently.
15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.
We make no guarantee that the Service will be uninterrupted, error-free, completely secure, or that all information provided through it will be accurate, complete, or current.
Nothing in this section excludes warranties or rights that cannot legally be excluded.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Island Seeker and its owners, directors, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of or reliance on the Service.
This includes losses arising from inaccurate or outdated property information, unavailable properties, third-party conduct, investment decisions, transactions, lost profits, or loss of data.
Where liability cannot legally be excluded, our aggregate liability arising from the Service will, to the extent permitted by law, be limited to the amount you paid to Island Seeker during the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
17. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold Island Seeker harmless from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Service, violation of these Terms, or infringement of third-party rights.
18. Privacy
Our collection and use of personal information are governed by our Privacy Policy.
By using the Service, you acknowledge that personal information may be processed as described in that policy.
19. Suspension and Termination
We may restrict, suspend, or terminate access to the Service where reasonably necessary, including in cases of fraud, security risks, non-payment, scraping, unauthorized redistribution, account sharing, abuse, or material violation of these Terms.
You may stop using the Service at any time.
Provisions that by their nature should survive termination—including intellectual property protections, disclaimers, and limitations of liability—will continue to apply.
20. Changes to These Terms
We may update these Terms from time to time.
The updated Terms will be posted on the Service with a revised “Last updated” date. Where required by law or where changes materially affect your rights, we will provide additional notice.
Continued use of the Service after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.
21. Governing Law and Disputes
These Terms are governed by the laws of Estonia, without regard to conflict-of-law principles.
Any disputes arising from these Terms or the Service will be subject to the jurisdiction of the courts of Tallinn/Estonia, except where applicable consumer law gives you the right to bring proceedings elsewhere.
22. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
Our failure to enforce a provision does not waive our right to enforce it later.
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations as part of a merger, acquisition, restructuring, sale of business, or similar transaction.
These Terms, together with any policies or additional terms expressly incorporated into them, constitute the agreement between you and Island Seeker concerning your use of the Service.
